Background

The National Chicken Council (NCC) is a Washington DC-based trade association representing the US poultry industry. The NCC seeks to influence US legislation and regulatory policies and “affect domestic and international trade policy” to benefit its members, as well as “maintain and expand” foreign markets for US-produced chicken. [1]

The NCC accounts for 95 percent of the broiler chickens produced in the US, according to its website. Its members include food giants Mountaire Corp, Tyson Foods and Pilgrim’s Pride, a subsidiary of the Brazilian company JBS SA. [1]

Mountaire’s owner and chairman, billionaire Ronald Cameron, donated $2 million to the pro-Trump Super PAC (Political Action Committee) Rebuilding America Now during the 2016 presidential election campaign. The company has also contributed $4.5 million to Americans for Prosperity Action, a super PAC affiliated with the Koch-funded group Americans for Prosperity, between 2018-2020. Mountaire was a major contributor to Freedom Partners, another Koch network organisation, before its dissolution in 2019. [2], [3], [3]

The NCC has played an active role in attempts to reduce environmental protections, including in post-Brexit trade talks between the UK and US. In May 2020, it worked with allies in congress to write to the US Trade Representative demanding that any US-UK trade deal bring to an end what it called the UK’s “unscientific ban” on chlorinated chicken. The US Trade Representative later warned the US would not agree to a trade deal where its food producers were “treated unfairly”. [4], [5]

In 2016, the year of the EU referendum and Donald Trump’s election, there was a surge in political donations from the US poultry industry. According to data from the transparency non-profit OpenSecrets, poultry producers gave a combined $19.4 million in 2016, with over 90 percent of contributions to parties and candidates going to Republicans. Mountaire accounted for $17.9 million of the total contributions while the NCC donated $258,000. [6], [7], [7], [8]

Overall, in the period between 2016 and 2020, the poultry industry gave $34.8 million in political donations, over three times the amount of previous election cycles. Mountaire was the top donor, contributing $30.9 million, while the NCC was the fourth top donor from the industry during this period, donating $708,500. [8], [7]

According to OpenSecrets data, the top recipients of NCC funds include Jim Costa (D-CA) and Steve Womack (R-AR) who co-chair the Congressional Chicken Caucus, an informal working group of both Republican and Democratic members of congress, many of whom represent the districts of major poultry producers. [9], [10]

While the NCC’s promotional website claims that “chicken production in the US is more sustainable than ever before”, the huge increase in production over the past several decades has come with significant environmental impacts. Since the 1950s, the number of chickens produced and consumed in the US has risen by over 1400 percent from an average of 580 million chickens per year to over 9 billion. Impacts include increased strain on land and water resources, particularly due to an increased use of mono-crops such as corn for animal feed. [11], [12], [13]

The NCC’s 65th Annual Conference in 2019 was sponsored by American bank JP Morgan Chase, which has invested over a quarter-of-a-trillion dollars in fossil fuels since the Paris Agreement, according to analysis by the Rainforest Action Network. [14], [15]

Stance on Climate Change

While the NCC appears to have made no explicit statement on climate change, it has consistently opposed provisions of the Renewable Fuel Standard (RFS), a regulation that requires US petrol and diesel suppliers to offer a minimum volume of “renewable” fuels derived from crops such as corn. In 2010, the NCC worked with a coalition of meat industry bodies to file a lawsuit against the Environmental Protection Agency (EPA) challenging an EPA decision to treat certain biofuels facilities as RFS compliant regardless of whether they managed to reduce emissions. [16], [17], [18]

In 2017, the NCC called on then EPA Secretary Scott Pruitt to reduce the volume of biofuels required by the RFS and in 2019, it again lobbied the EPA to reduce the requirement, calling it “overly aggressive”. The NCC’s action has been taken over concerns about the rise in the price of corn which is used for chicken feed and which is the principal ingredient in ethanol, which accounts for most US-produced biofuel. [19], [20], [21]

Scientists have disputed the US Government’s claim that biofuels are “carbon neutral”, with research suggesting the life-cycle greenhouse gas emissions of biofuels can exceed those of conventional fossil fuels due to the significant carbon and environmental impacts of land clearing. [22], [23]

Funding

The National Chicken Council collects funds from members to support its work.

Member contributions accounted for $4,199,415 out of a total revenue of $4,739,835 in 2018. Other funding sources included $301,645 in “contributions and grants”, $156,850 from “conference[s] and seminar[s]”, and $62,500 in “legal assessment” in 2018, according to its 990 form.

The NCC also raises funds through its Political Action Committee (PAC). These are distributed to congressional candidates “who support the industry”. Top recipients of PAC funds in 2020 were Congressional Chicken Caucus Co-Chairs Steve Womack (R-AR) and Jim Costa (D-CA), Congressmen Buddy Carter (R-GA) and David Scott (D-GA) and Senators Doug Collins (R-GA) and Chris Coons (D-DE) who each received $10,000. The NCC PAC raised a total of $1,138,413 between 2016 and 2020. [24], [25], [26], [24]

According to DeSmog analysis of Federal Election Commision data, individuals from the following organisations donated the following amounts to the National Chicken Council PAC, formerly know as the National Broiler Council PAC (1979 - 2007) and the Broiler Industry Good Government Committee (1976 - 1978). Responding to a video campaign launched by the RSPCA which aimed to highlight the difference in animal welfare and health and safety standards in the UK and US, and criticised the sanitary conditions many US-produced chickens were farmed in, the NCC’s Senior Vice President of Scientific and Regulatory Affairs, Dr Ashley Peterson, stated: [47]

Poultry processors consider the welfare of the birds a top priority. Not only is it the right thing to do ethically, but it does not make economic sense to mistreat the birds.” [47]

The US Department of Agriculture’s Food Safety and Inspection Service (FSIS) has guidelines and directives addressing appropriate handling of birds under the federal Poultry Products Inspection Act, and chicken processors strictly adhere to their animal welfare guidelines. This whole process is routinely audited internally, by independent third party auditors and by customers. It is monitored on a continuous basis by FSIS inspectors.” [47]

Ahead of the opening of US-UK post-Brexit trade talks in May 2020, the NCC worked with allies in Congress to demand that the US negotiate an end to the UK ban on chlorinated chicken in any trade deal. The letter, sent from Members of Congress to US Trade Representative, Robert Lighthizer, “stress[ed] the importance of including US poultry products” in a US-UK deal, calling for the US government to negotiate an end to the ban “once and for all”. [4]

According to analysis of OpenSecrets data by Greenpeace’s investigative unit Unearthed, 29 of the 47 signatories had taken donations from the NCC since 2016, receiving a total of $287,500 in donations between them. This included donations totalling $27,800 to Congressman Steve Womack, who coordinated the letter and who is one of the top recipients of NCC funds. The NCC also supplied an endorsement to Womack’s press release about the initiative and publicised the letter on its website. [48], [26][49], [50]
